1. General Provisions
These Terms of Use govern access to and use of the SeaJobs website located at seajobs.ru, including all related pages, sections, user accounts, services, forms, databases, and platform functionality.
These Terms apply to registered and unregistered users, including Seafarers, Companies, Company representatives, guest-form users, website visitors, and any other persons using SeaJobs.
If a specific SeaJobs feature is subject to special rules, tariffs, interface terms, separate consents, offers, service descriptions, or other related documents, those documents apply to the relevant feature to the extent they do not conflict with these Terms and, where expressly stated, take precedence.
2. Key Definitions
For the purposes of these Terms:
- Website, Platform, or SeaJobs means the information resource located at seajobs.ru and its functionality intended for publishing and searching vacancies, resumes, company profiles, bulletin board posts, user interaction, and additional free or paid digital services.
- Administration means the person or entity operating and managing the SeaJobs Platform.
- User means any person using the Website.
- Seafarer means a User who uses the Platform to create a profile or resume, submit applications, use subscriptions, CV Mailer, Auto-Apply, and other services connected with job search or employment.
- Company means a legal entity, individual entrepreneur, or authorised representative of an employer, crewing company, shipping company, or other hiring customer using the Platform to publish company information, vacancies, and work with candidates.
- User Content means any information, files, and materials uploaded, published, sent, or otherwise made available by a User through the Website, including texts, vacancies, resumes, photos, documents, messages, and bulletin board posts.
- Paid Services means SeaJobs digital or information services provided for a fee, including, without limitation, Premium features for Seafarers, Premium features for Companies, CV Mailer, guest CV Mailer, and any other functionality marked as paid in the relevant interface.
3. Acceptance and Platform Status
Use of the Website, account registration, signing in, publishing a resume, vacancy, or bulletin board post, applying for a vacancy, using guest forms, enabling notifications, ordering or paying for a Paid Service, or otherwise using SeaJobs functionality constitutes acceptance of these Terms in full, without reservations.
SeaJobs is an information platform and, unless expressly stated otherwise, is not an employer, recruitment agency, user representative, guarantor, employment intermediary, or party to agreements between a Seafarer and a Company.
The Administration provides the technical ability for users to interact with one another but does not guarantee the conclusion of any employment or civil contract, actual employment, an interview invitation, a response, an offer, profile views, or any other economic result.
The User confirms that they have the legal capacity, authority, and right to use the Website and, when acting on behalf of a Company, that they do so in that Companys interests and with proper authority.
4. Registration and Account
- Certain SeaJobs features require registration. Users must provide accurate, up-to-date, and non-misleading information.
- Users are solely responsible for safeguarding their login credentials and any other account access tools, as well as for all actions performed through their account until the Administration is notified of a security breach.
- The Administration may request confirmation of email address, account details, Company identity, representative authority, or any other information necessary for platform security, moderation, or access to specific functionality.
- The Administration may restrict, suspend, refuse to activate, or terminate access to an account where information is inaccurate, where there is a suspected breach of law or these Terms, where platform abuse is suspected, or where security, user rights, or the Platform itself may be at risk.
- Users may not transfer, sell, lease, share, or otherwise provide access to their account to third parties beyond the functionality expressly allowed by the Platform, nor may they create accounts using someone elses data without lawful grounds.
5. Rules for Seafarers
- A Seafarer may create and edit a profile and resume, upload documents, subscribe to vacancies and notifications, and use available application, CV Mailer, Auto-Apply, and other functions available for their account category and active tariff.
- A Seafarer must publish only accurate information about themselves, their qualifications, experience, documents, certificates, medical fitness, and other professional information.
- A Seafarer is responsible for the legality of uploading and using photos, documents, and other materials and for having all rights required to publish them on the Platform.
- SeaJobs may, at its sole discretion and without explanation, refuse publication, limit visibility, unpublish, or remove a Seafarers profile, resume, documents, or other content if such content violates the law, these Terms, third-party rights, data quality standards, or formatting requirements.
- A Seafarer agrees that their profile and resume data may be made available to Companies to the extent provided by platform logic, visibility settings, and the relevant feature. When the Seafarer uses direct resume sending, applications, or CV Mailer, the relevant data is sent to the selected recipients or those determined by the feature logic.
- SeaJobs does not guarantee that a Seafarers resume will be viewed by any particular number of Companies, or by any Company at all, and does not guarantee responses, invitations, offers, or employment.
6. Rules for Companies
- A Company may create a company profile, publish vacancies, work with applications and candidates, use Pipeline, notifications, search tools, Premium features, and other functions available for the relevant account category and tariff.
- A Company confirms that it has the authority required to publish vacancies, represent the employer, and process candidate data for recruitment purposes.
- A Company must publish vacancies and related information that is lawful, accurate, current, and not misleading as to the employer, working conditions, salary, requirements, location, vessel, route, contract term, or other material terms.
- A Company undertakes to use candidate data received through SeaJobs only for searching, evaluating, recruiting, and hiring personnel, and for communication regarding vacancies and related recruitment processes.
- If a Company stores, copies, exports, prints, downloads, or otherwise uses candidate data outside the SeaJobs interface, that Company is solely responsible for such further processing and for compliance with applicable law, including personal data and advertising law.
- The Administration may moderate Companies and vacancies, request additional documents and information, restrict publications, candidate access, and specific functions, and block a Company for breaches of law, these Terms, user rights, suspected fraud, improper data collection, or other abuse.
7. User Content and Moderation
Users are solely responsible for all content they publish, for the consequences of publication, for the accuracy of that content, for having the rights required to publish it, and for ensuring its compliance with the laws of the Russian Federation and the rights of third parties.
By publishing content on the Website, the User grants the Administration a simple non-exclusive, royalty-free licence for the period of publication and to the extent necessary for operating the Platform, including the right to store, reproduce, process, format, publish, display, communicate to the public, and otherwise use such content for the functioning, development, promotion, and protection of SeaJobs.
The Administration may, but is not obliged to, review User Content. Moderation does not mean that the Administration assumes responsibility for such content.
The Administration may, without prior notice, refuse publication, unpublish, hide, restrict visibility of, remove, or block any content and related account where it considers this necessary to comply with law, these Terms, the interests of the Platform, user safety, SeaJobs business reputation, or third-party rights.
8. Paid Services
SeaJobs may provide both free and Paid Services. At the time of use, Paid Services may include, without limitation, Premium for Seafarers, Premium for Companies, CV Mailer, guest CV Mailer, and any other features expressly designated as paid in the relevant interface.
The name, scope, duration, limits, price, currency, payment method, activation process, and other material conditions of a Paid Service are shown in the ordering interface, account interface, tariff card, payment form, order confirmation, or another related interface and form part of the agreement between the User and the Administration.
- Payment for a Paid Service means that the User agrees with the price, parameters, term, delivery format, and other conditions displayed before payment.
- Where payment is processed through a third-party payment service, the transaction is handled by the relevant payment provider. The Administration does not process full bank card details.
- A Paid Service is deemed properly provided where the Administration has granted technical access to the relevant function, activated the subscription period, credited the relevant limit, package, credit, access, or performed another digital action corresponding to the service description. SeaJobs does not guarantee that the User will achieve a desired result, including employment, profile views, responses, candidates, invitations, or any other external outcome.
- Where a Paid Service is time-based, the service period runs from the activation date unless another date is expressly specified. Where the service is measured in credits, packages, mailings, placements, or other units, the volume is consumed as the relevant function is used.
- The Administration may change the composition, price, availability, and conditions of new Paid Service purchases unilaterally. Such changes do not apply retroactively to already paid and activated service volume unless otherwise required by law or by the conditions of the relevant service.
- A User may refuse a Paid Service in the cases and order provided by the laws of the Russian Federation. In the event of a refund, the Administration may deduct the value of services already rendered, digital access already granted, actual expenses incurred, and commissions where this is permitted by law and consistent with the nature of the service.
- Where a Paid Service has already been fully or partly activated, fully or partly used, or has already started being performed in digital form at the Users initiative, any refund is determined taking into account the volume of services already provided and the applicable legal requirements.
- SeaJobs is not liable for inability to pay, delays, errors, cancellations, refunds, or other issues caused by banks, payment systems, acquirers, telecom operators, external services, or the User, unless such issue was caused by the Administrations own fault.
9. Prohibited Actions
- Publishing unlawful, false, misleading, offensive, fraudulent, discriminatory, harmful, or otherwise unacceptable information.
- Using the Platform for purposes other than those intended, including spam, unsolicited mass communications, unauthorised contact harvesting, phishing, fraud, circumvention of restrictions, or manipulation of rankings, statistics, or search results.
- Publishing vacancies, announcements, or messages that are unrelated to the Platform purpose, violate the law, advertise prohibited schemes, require advance payment for fraudulent purposes, or otherwise create risks for users.
- Using automated scripts, parsers, bots, scraping tools, bulk copying tools, or restriction-bypass mechanisms without the Administrations prior written consent.
- Attempting to gain unauthorised access to accounts, data, source code, APIs, admin panels, servers, networks, queues, payment systems, or any internal SeaJobs systems.
- Using personal data obtained through SeaJobs for purposes unrelated to the operation of the Platform, recruitment, hiring, or other clearly permitted scenarios.
- Violating intellectual property rights, portrait rights, database rights, trade secrets, trademark rights, or any other rights of SeaJobs or third parties.
10. Intellectual Property
The Website, its software code, structure, arrangement of materials, design, the SeaJobs name, logos, graphics, Administration texts, databases, and other platform elements, excluding User Content, belong to the Administration or are used on a lawful basis.
Any copying, adaptation, reproduction, distribution, public display, data extraction, creation of derivative databases, decompilation, reverse engineering, or other use of Platform elements without prior written consent of the Administration is prohibited unless expressly permitted by law.
Use of resumes, vacancies, company descriptions, announcements, and other User Content outside the Website is permitted only where there is a lawful basis and in compliance with the rights of the relevant persons and the intended purpose of the Platform.
11. Limitation of Liability
To the maximum extent permitted by the laws of the Russian Federation, the Administration is not liable for the actions or omissions of users and third parties, the accuracy of User Content, the reality of vacancies, the authority of Company representatives, the content of correspondence between users, hiring results, refusal to hire, termination of employment, or any agreements reached between Seafarers and Companies, whether using the Platform or otherwise.
The Administration does not guarantee uninterrupted, continuous, error-free, or fully secure operation of the Website, the absence of viruses, compatibility with any specific device, browser, software, or telecom operator, and is not liable for temporary failures, interruptions, data loss, processing delays, access restrictions, or other consequences of technical malfunctions unless caused intentionally by the Administration.
SeaJobs is not liable for damages, lost profits, loss of clients, revenue, reputation, data, or any other indirect or consequential loss arising from use of or inability to use the Website, except where such liability cannot be excluded under mandatory law.
Where a Company or another user stores, copies, exports, or otherwise uses candidate data and other information outside the SeaJobs interface, that user bears full responsibility for the legality of such further use.
12. Term, Changes, Law, and Contact
These Terms take effect from the moment the User starts using the Website and remain in force until the User stops using the Website or until the Terms are terminated on grounds provided by law or by these Terms.
The Administration may amend these Terms unilaterally at any time. The new version becomes effective upon publication on the Website unless another effective date is specified in that version. Continued use of the Website after publication means acceptance of the changes.
The Administration may suspend, restrict, or terminate a Users access to the Website in whole or in part without prior notice where this is necessary to comply with law, maintain security, prevent abuse, protect the Platform, protect third-party rights, or respond to a breach of these Terms.
Relations of the parties are governed by the laws of the Russian Federation. A pre-trial claim procedure applies where required by law. Users acting as consumers retain all rights granted by mandatory consumer protection law. Disputes with Users who are not consumers are to be considered at the location of the Administration unless the law provides otherwise.
